Agreement to Receive Text Messages 

By providing your mobile telephone number and affirmatively opting into any California Wildfire Help(“California WildFire Help,” “Company,” “we,” “our,” or “us”) text messaging program, you expressly consent to receive recurring automated marketing, promotional, informational, transactional, customer service, account-related, and operational text messages from California Wildfire Help at the mobile number provided. 

Messages may be sent using an automatic telephone dialing system, automated technology, or other messaging technology where permitted by applicable law. 

Your consent to receive text messages is voluntary and is not a condition of purchasing any goods, services, memberships, subscriptions, or other offerings from California Wildfire Help. 

By enrolling in a messaging program, you certify that you are the authorized user or subscriber of the mobile telephone number provided and that you have authority to consent to receiving messages at that number. 

Program Description 

California Wildfire Help may use text messaging to provide account notifications, login verification codes, password reset codes, security alerts, customer support communications, review notifications, comment notifications, content updates, service announcements, newsletters, surveys, promotional offers, special events, product announcements, marketing campaigns, and other information relating to the Services. 

The content, timing, and frequency of messages may vary based on user activity, account preferences, participation in promotions, customer support interactions, and other factors. 

Message Frequency 

Message frequency varies. The number of messages you receive will depend upon your interactions with California Wildfire Help, your account settings, your participation in promotions or messaging programs, and your use of the Services. 

California Wildfire Help does not guarantee any minimum or maximum number of messages. 

Message and Data Rates 

Message and data rates may apply to any messages sent or received through our messaging programs. 

Charges are determined solely by your wireless carrier and your mobile service plan. California Wildfire Help is not responsible for any charges imposed by your carrier. 

Opt-Out Instructions 

You may opt out of receiving marketing and promotional text messages at any time by replying STOP to any text message received from California Wildfire Help. 

After we receive your STOP request, we may send a one-time confirmation message confirming your opt-out request. Following confirmation, you will no longer receive marketing text messages unless you subsequently provide a new opt-in. Additional opt-out commands that may be recognized include CANCEL, END, QUIT, UNSUBSCRIBE, or STOP ALL. 

Please note that opting out of marketing messages does not prevent us from sending transactional, account-related, security, legal, or administrative communications where permitted by law.

Supported Carriers 

Messaging services may not be available on all wireless carriers, devices, or geographic locations. 

Participating carriers may change without notice. Carrier participation does not constitute endorsement of any messaging program offered by California WildFire Help. 

 

Wireless Carrier Disclaimer 

Wireless carriers are not liable for delayed, failed, incomplete, misdirected, corrupted, or undelivered messages. 

Delivery of text messages is subject to effective transmission by your wireless service provider and network availability. California Wildfire Help does not guarantee message delivery and shall not be responsible for delays caused by carrier restrictions, network outages, technical failures, equipment malfunctions, or circumstances beyond our reasonable control. 

Changes to Mobile Telephone Numbers 

If your mobile telephone number changes, you agree to promptly notify us and, if necessary, re-enroll in our messaging programs using your new number. 

You agree that failure to update your mobile number may result in messages being delivered to unintended recipients, and you release California Wildfire Help from liability arising from such circumstances. 

Privacy and Data Usage 

Information collected through our messaging programs is governed by our Privacy Policy. 

By participating in any messaging program, you acknowledge that your information may be collected, processed, stored, disclosed, and used in accordance with our Privacy Policy. 

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. 

Information sharing to subcontractors, service providers, and vendors providing support services, including customer service providers, platform providers, hosting providers, analytics providers, and text message delivery providers, is permitted solely for the purpose of supporting our business operations. 

Text messaging originator opt-in data, consent records, and mobile phone numbers collected for messaging purposes will not be sold, rented, leased, transferred, disclosed, or otherwise shared with any third party for its own marketing or promotional purposes. 

Suspension, Modification, and Termination 

California Wildfire Help reserves the right to modify, suspend, restrict, discontinue, or terminate any messaging program, in whole or in part, at any time and without prior notice. 

We reserve the right to modify message content, delivery methods, supported programs, participating carriers, enrollment procedures, and eligibility requirements at our sole discretion. 

Disclaimer of Warranties 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL MESSAGING PROGRAMS ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS. 

CALIFORNIA WILDFIRE HELPDISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, OR UNINTERRUPTED OPERATION. 

Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALIFORNIA WILDFIRE HELP, ITS AFFILIATES, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO ANY MESSAGING PROGRAM. 

THIS LIMITATION INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM DELAYED, FAILED, INCOMPLETE, MISDIRECTED, CORRUPTED, OR UNDELIVERED MESSAGES, NETWORK FAILURES, SERVICE INTERRUPTIONS, DATA LOSS, OR CARRIER ERRORS. 

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF CALIFORNIA WILDFIRE HELPEXCEED ONE HUNDRED DOLLARS ($100.00). 

Indemnification 

You agree to defend, indemnify, and hold harmless California Wildfire Help and its affiliates, officers, directors, employees, contractors, agents, successors, and assigns from and against any claims, damages, liabilities, losses, costs, expenses, penalties, and attorneys’ fees arising out of your participation in any messaging program, your violation of these Mobile Messaging Terms, or your misuse of any messaging service. 

Governing Law 

These Mobile Messaging Terms shall be governed by and construed in accordance with the laws of the State of Michigan without regard to conflict-of-law principles. 

Dispute Resolution 

To the fullest extent permitted by law, any dispute arising out of or relating to these Mobile Messaging Terms or any messaging program shall be governed by the dispute resolution, arbitration, class action waiver, and venue provisions contained in the California Wildfire Help Terms of Service, which are incorporated herein by reference. 

Changes to These Terms 

California Wildfire Help reserves the right to modify these Mobile Messaging Terms at any time. 

Updated versions shall become effective immediately upon posting. Continued participation in a messaging program following publication of revised terms constitutes acceptance of such revisions.
